Availability of Products
In these terms and conditions, when we refer to “products” we mean any of the goods or services sold or made available through this Web Site.
We do not warrant or represent that any product featured on the Web Site will be available at the time you place an order. Availability may vary depending upon the nature of the product chosen.
All information available on our Web Site in respect of our products constitutes an invitation to treat and not an offer by us to be bound to supply those products. An offer will only arise in the circumstances set out below (see “How Is A Contract Made With Excellence Aviation Services Limited” below).
In certain circumstances we may offer you the ability to purchase some of our products before they become generally available to the public. We call this process pre-ordering. In these circumstances you understand that the relevant products will not be available at the time your order is placed, but will be available at a later date. We will identify in advance those products which may be pre-purchased and we will inform you prior to placing the order of the time we estimate prior to us receiving and dispatching the pre-ordered products to you.
How Is A Contract Made With Excellence Aviation Services Limited
When you submit an order to purchase one of the products featured on our Web Site, we will send you an e-mail confirming the details of your order. Should any of these details be incorrect, you should let us know by phone, e-mail or telephone immediately. If the details are correct, you need do nothing further.
Your submission to Excellence Aviation Services Limited constitutes an offer to Excellence Aviation Services Limited to purchase the goods which may be accepted by us. Acceptance of your offer will occur upon Excellence Aviation Services Limited dispatching the goods ordered. No act or omission of Excellence Aviation Services Limited prior to the actual dispatch of the goods ordered will constitute acceptance of your offer.
Languages Available For Conclusion Of The Contract
English is the only language available for you to place your order with LibAbun Business Angels Limited.
Unavailability
If the goods you have ordered from us are not available, we will contact you by e-mail to advise you of such. In our e-mail we will offer you the option to place your order on back-order for fulfilment when the relevant products are available (so long as we intend to replenish our stock of the relevant product in question), or to cancel your order without penalty.
Cancellation Rights
Customers within the European Union are entitled to a cooling-off period of seven (7) business days (beginning on the day after the day on which you receive the goods) during which you may cancel the contract made with Excellence Aviation Services Limited. Should you wish to exercise this right, you must;
- Within the time period above, give written notice (by e-mail, fax or letter) to Excellence Aviation Services Limited indicating your intention to cancel the contract and;
- Return the goods already delivered to you at your cost.
In the event that you choose to cancel your agreement with us we will issue you with a refund once we have received the goods originally delivered to you. We strongly recommend that you only send such goods by recorded delivery for your own protection.
Excellence Aviation Services Limited may, in its absolute discretion and depending upon the facts of a particular case, extend the right to cancel to customers outside the European Union.
Gift Vouchers and Discount Codes
Excellence Aviation Services Limited Shop gift vouchers and discount codes are non-refundable and have no cash value. Excellence Aviation Services Limited Shop gift vouchers and discount codes are redeemable online only.
When using a Excellence Aviation Services Limited Shop gift voucher or a discount code to make a purchase on this Web Site, no change or credit will be given where the value of the gift voucher or discount code used exceeds the value of the order. If the order value exceeds the amount of the gift voucher or discount code, the balance must be paid by one of our other available payment methods. Only one gift voucher or discount code can be redeemed against an order, all gift vouchers or discount codes are limited to one per customer, one per household and one per business.
Excellence Aviation Services Limited disclaims all responsibility for any lost gift vouchers or discount codes.
Liability
Excellence Aviation Services Limited will not be liable for any indirect or consequential losses resulting from our breach of contract. We will also not be liable for any loss of profit you may incur as a result of our non-performance. Excellence Aviation Services Limited maximum liability in the event it breaches a contract concluded with you (or is otherwise negligent, acts in breach of trust or in breach of statutory duty) shall be limited to the value of goods ordered.
Nothing in these Terms is intended to exclude Excellence Aviation Services Limited liability for fraud, personal injury caused by the negligence of its employees or anything else that cannot be excluded by operation of law.
Miscellaneous
Excellence Aviation Services Limited shall have no liability for any breach of contract caused by circumstances beyond its reasonable control.
A person who is not a party to any contract made shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
Governing Law
Any contract made between Excellence Aviation Services Limited and you will be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English and Welsh courts.
